Moderation and Usage Policy

1. Contributing to the forum

Forum comments are limited to 500 words.

All forum comments are moderated by the Department of Social Services (the Department) and its appointed representatives to ensure that the discussion remains on topic, does not include offensive or discriminatory language and that no person's privacy or security is breached. Moderators check all comments against the Moderation Policy, Protocols for Participation and Terms of Use as set out below.

2. Moderation Policy

The Department welcomes your participation in The Line forum. To ensure that your contribution meets legal requirements and the discussion stays on track, all comments posted to the forum will be moderated by the Department according to the Protocols for Participation. The Department endeavours to moderate all forum comments within 10 minutes after publishing and those that do not comply with the Protocols below will be removed.
Moderators will not edit comments. Contributions will only be moderated in accordance with the Protocols.

3. Protocols for Participation

The intent of the Protocols for Participation is to create a positive environment where people are able to publicly contribute their views to the forum, in the spirit of promoting respectful relationships, without fear of abuse or harassment or exposure to offensive or otherwise inappropriate content and protecting the operators of the consultation forum from legal liability.

Commenting in The Line forum is like having a conversation or speaking at a physical meeting, so normal social conventions apply. Help us to keep the conversation on topic by being polite, constructive and respectful of others.

By contributing to the forum, you:

  • give permission for your comments to be posted on the site (see Privacy Statement) and affirm that your comments represent your own work and do not infringe on the copyright of any other individual or organisation
  • acknowledge that your comments for The Line forum will be moderated by Departmental moderators after publication and may be removed if they do not comply with the Protocols.
  • acknowledge and give permission for your comments to be used, without personal identification, by the Department and/or the Government for any purpose
  • acknowledge that comments that contain images, audio or video will not be published, irrespective of content
  • acknowledge all material on this site is subject to copyright. For more information, view the Copyright Statement.

When contributing your views to this forum, you will ensure that you:

  • do protect your personal privacy and that of others by not including personal information about yourself or others in your comments, (such as names, email addresses, private addresses or phone numbers)
  • do post material to the forum that is relevant to the issues being consulted on
  • do represent your own views and do not impersonate or falsely represent any other person
  • do not abuse, harass or threaten others
  • do not post anything which:
    • racially or religiously vilifies others,
    • incites, induces or aids violence, discrimination, harassment, victimisation or hatred towards others, or
    • is likely to offend, insult or humiliate others, particularly on the basis of their race, colour, descent, national origin, religion, ethnicity, gender, age, sexual orientation or any disability
  • do not make defamatory or libellous comments
  • do not use insulting, provocative or hateful language
  • do not use obscene or offensive language
  • do not post material to the forum that infringes the intellectual property rights of others
  • do not post multiple versions of the same view to the forum
  • do not promote commercial interests in your posts to the forum
  • do not include internet addresses, videos, images or any email addresses, in your contribution
  • do not post comments promoting personal professional interests
  • do not post overtly party political comment (e.g. reference to candidates, fundraisers, support for political parties) and
  • do not incite, encourage or make reference to conduct that may constitute a criminal or civil offence or otherwise violate law.

Forum comments that do not comply with these Protocols will be removed. Contributions will only be moderated in accordance with the Protocols.

4. Terms of Use

The Line forum is managed by the Department of Social Services.

Your use of The Line forum is deemed to be your acceptance of these Terms of Use. Please read them carefully.

Lawful purposes
You agree to use The Line forum only for lawful purposes, and in a manner that does not infringe the rights of or restrict or inhibit the use and enjoyment of The Line forum by any third party. This includes conduct which is unlawful or which may harass or cause distress or inconvenience to any person, the transmission of obscene or offensive content or disruption to The Line forum.

Disclaimer
Your use of The Line forum does not:

  • affect or reduce any obligation any Agency owes You;
  • affect or reduce any obligation You owe to any Agency.

The Line forum are not a substitute for independent professional advice and you should obtain any appropriate professional advice relevant to your particular circumstances.

Content and comments

You are responsible for the comments you make on The Line forum. If you wish to comment on The Line forum, you must do so in accordance with these terms, the Protocols for Participation and our Moderation Policy.

Security

The Department will strive to protect comments and information you provide on The Line forum. The Department will use all reasonable endeavours to ensure that your comments and information are not compromised. However, we cannot guarantee that no harmful code will enter The Line forum. You should be aware of the risks associated with using the websites.

The Department recommends that you use appropriate and up-to-date firewall and anti-virus software to protect your computer systems.

Privacy

The Line forum requires users to submit a valid email address to be used for verification purposes.

The Department will only use and disclose your information to a person, body or other Agency:

  • to provide you with a service that you have requested;
  • as authorised by law, for example, if a law enforcement authority or court order lawfully directs us to disclose the information of a user.

General
These Terms of Use are governed by the laws of the Australian Capital Territory, Australia and you agree to submit to the exclusive jurisdiction of the courts of the Australian Capital Territory.

If any of these Terms of Use are held to be invalid, unenforceable or illegal for any reason, the remaining Terms of Use will continue in full force.

These Terms of Use do not negate any Terms or Conditions that apply to your use of any other government website.

The Department may revise these Terms of Use from time to time. Please contact the Department if you have any questions, problems or feedback regarding The Line forum.

The Line Website - User Terms

1. General
1.1 The Line Website, located at http://www.theline.gov.au ("The Line Website") is owned and operated by the Commonwealth of Australia, acting through the Australian Government Department of Social Services ("the Department").
1.2 Any and all use of The Line Website is subject to the terms and conditions set forth herein ("User Terms"), which are accepted by you and any other person accessing or using the Line Website ("You" or "User"). These User Terms may be updated or revised by the Department from time to time without notice to You. The current version is always available on The Line Website, under ‘Terms and Conditions', located at http://www.theline.gov.au/terms_conditions.
1.3 Together with The Line Website's Privacy Policy, which is available at http://www.theline.gov.au/privacy, these User Terms govern Your use of The Line Website in respect of the all services provided on the website, and including the Service (as defined in paragraph 2.1, below).
1.4 Unless otherwise stated, these User Terms apply to all Users. The Department may, in its sole discretion, decline to permit anyone to use the Service by blocking the User's access to The Line Website or by some other technical means of preventing a User from accessing to The Line Website, without giving any reason(s).
2 The Service
2.1 The Department is the provider of a service on The Line Website by which You are permitted to download digital content without charge, including but not limited to sound recordings embodying an underlying musical work (collectively, the "Music") and any associated cover artwork, which may then be used by You for end-user use only in accordance with the terms and conditions set forth in this Agreement, and the provisions of the Copyright Act 1968 (Cth.) (the "Service").
3. Requirements for use of the Service
3.1 The Service is available for individuals aged 12 years or older. If You are 12 or older but under the age of 18, You should review this Agreement with Your parent or guardian to make sure that You and Your parent or guardian understand it. If requested to do so by the Department, the User must, if a minor, provide a copy of the Guardian Approval Form ("Guardian Approval Form"), which is an annexure to these Competition Terms, signed by the User's guardian.
3.2 Use of the Service requires a computer or other compatible device, internet access, internet browsing software, may require periodic updates, and may be affected by the performance of these factors. You acknowledge and agree that these requirements, which may change from time to time, are solely Your responsibility. The Service is not part of any other product or offering, and no purchase or obtaining of any other product shall be construed to represent or guarantee You access to the Service.
4. Your Use of the Service
4.1 As a User of the Service, You may be provided with the opportunity to download certain Music, which You may retain on Your computer's storage drive and keep for Your own personal access, and for Your own personal use at any time for private, domestic, personal and non-commercial purposes only ("Purposes"). Such access, and the right to use the Music for the Purposes, is provided to You as an accommodation only, and the Department does not warrant, and will not have any liability or responsibility for such Music, or Your authorised or unauthorised use thereof, or for any use that is inconsistent with the Purposes. You agree that You will not use the Music in any manner that would infringe or violate these User Terms, the rights of any other party, or the provisions of the Copyright Act 1968 (Cth.), and that the Department is not in any way responsible for any such use or misuse by You.
4.2 You acknowledge that the Music made available to You by means of the Service may include content that is owned by third parties. The Department may also provide links to third-party websites as a convenience to You. You agree that the Department is not responsible for examining or evaluating the content or accuracy of such third-party websites and that the Department does not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties. You agree that You will not use any third-party materials in a manner that would infringe or violate the rights of any other party and that the Department is not in any way responsible for any such use by You.
4.3 You agree that the Service, including but not limited to the Music and all software, artwork, graphics, video, text, interfaces, trademarks, logos, images, photographs, and any other element of The Line Website (collectively "Content"), including but not limited to the layout, election, organisation, and co-ordination of such Content on the website is the property of or is licensed to the Department, and is protected by trademark, copyright, and the provisions of the Copyright Act 1968 (Cth), and other intellectual property rights laws. You agree that You will not use such Content or materials in any way whatsoever except for use of the Service in compliance with this Agreement. No portion of the Service may be reproduced in any form or by any means except as expressly permitted by this Agreement. You agree not to modify, rent, lease, loan, sell, distribute, communicate to the public or create derivative works based on the Service, including the Music and associated artwork, in any manner, and You shall not exploit the Service in any unauthorised way whatsoever. Without the prior written consent of the Department, and except as provided in these terms of use, no Content may be copied, reproduced, transmitted/translated, publicly displayed, uploaded, published, recorded, retransmitted, rented, sold, distributed, communicated to the public, digitized, marketed, reproduced, altered to make new works, performed, or compiled in any way to any other computer, website, or other medium for any commercial purpose.
By using this Service, You only obtain the right to download and stream the Music and other materials on Your PC or other device. You may not make or distribute copies to any other person or entity.
4.4 Trademarks, artist names, service marks, graphics, and logos used in connection with the Service and the Music, are the intellectual property, and, as the case may be, the trademarks of their respective owners. You are granted no right or license with respect to any of the aforesaid intellectual property, trademarks and any use of such intellectual property or trademarks.
5. Changes to the Service
5.1 Notwithstanding any other provision of this Agreement, the Department and its licensors, departments, sub-departments, employees and agents, reserve the right to change, suspend, remove, or disable access to any Songs, content, or other materials comprising a part of the Service at any time without notice. In no event will the Department be liable for making these changes. The Department may also impose limits on the use of or access to certain features or portions of the Service, in any case and without notice or liability.
6. Termination
6.1 If You fail, or the Department suspects that You have failed, to comply with any of the provisions of this Agreement, the Department, at its sole discretion, without notice to You may:
(i) terminate this Agreement, and take legal action against You for breach of this Agreement; and/or
(ii) preclude access to the Service (or any part thereof).
7. Indemnity
7.1 By using the Service, You agree to indemnify and hold the Department, its departments, officers, representatives, employees, affiliates, agents, contractors, and licensors harmless with respect to any claims arising out of Your breach of these User Terms, Your use of the Service, or any action taken by the Department as part of its investigation of a suspected violation of the User Terms or as a result of its finding or decision that a violation of the User Terms has occurred.
8. Changes to this Agreement
8.1 The Department reserves the right at any time to modify this Agreement and to impose new or additional terms or conditions on Your use of the Service by email or by posting on the website. Such modifications and additional terms and conditions will be effective immediately and incorporated into this Agreement. Your continued use of the Service will be deemed acceptance thereof.
9. Miscellaneous
9.1 If any part of this Agreement is held to be invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. The Department's failure to enforce any right or provisions in this Agreement will not constitute a waiver of such or any other provision. The Department will not be responsible for failures to fulfill any obligations due to causes beyond its control.
10. Jurisdiction
These Terms, and any claim relating to the Competition, is governed by the law as it applies in the Australian Capital Territory, Australia, and Users consent to the exclusive jurisdiction of the courts of New South Wales, Australia in relation to any and all disputes.
GUARDIAN'S APPROVAL
This document is annexed to and made part of the User Terms in respect of The Line Website. It sets out the terms of Your approval for the User to access and use the website. Unless otherwise stated, all capitalised terms in this Guardian's Approval Form have the same meaning as they are given in the User Terms.
(1) You have read the User Terms, and You have formed the view that they are beneficial to the User.
(2) You agree and accept that by signing this Guardian's Approval Form You are accepting the User Terms on behalf of the User and such terms shall constitute an agreement between the Department and the User.
(3) The warranties and representations of the User in the User Terms are, to the best of Your knowledge, information and belief, true in every particular.
(4) You will not, either by word or conduct by act or omission, interfere with or prevent the Department from carrying out the terms of the User Terms.
(5) You will not, either by word or conduct, or by act or omission, interfere with or prevent the User from carrying out the terms of the User Terms.
(6) You will do all things reasonably necessary to ensure that the User complies with the terms of the User Terms.
(7) Notwithstanding the User's legal minority, the User has sufficient mental capacity to understand the terms of the User Terms.

General
